TERMS OF USE FOR SAGOAI

These terms of use apply when you use SagoAI.

By creating an account or using SagoAI, you agree to these terms. If you do not accept the terms, please do not use the service.

1. About SagoAI

SagoAI is a digital service from WeNova that offers stories, activities, and other features for children and families.

The Service includes both ready-made content and features where artificial intelligence is used to create personalised stories, illustrations, audio narration, and other content based on the choices and information provided by the user.

In these Terms:

  • "SagoAI" or "The Service" for the app and associated services.
  • "we", "us" or "our" for WeNova.
  • "User" or "you" refers to the adult person who creates or is responsible for the account.

Information on how personal data is processed can be found in our Privacy Policy.

2. Account and Age Requirements

You must be at least 18 years old to create and manage an account in SagoAI.

Children may use parts of SagoAI under an adult's supervision. In the app, the adult can create local story profiles using preset characters and creative names. Story profiles are not user accounts and are not intended to contain the child's real name, age, or other personal data.

The age group selected when creating a story indicates the reading level of the story and is not intended to indicate or store the child's actual age.

You are responsible for:

  • the information you provide is correct,
  • your login details are kept secure,
  • your account is used in accordance with these Terms.

Please contact us if you suspect that someone unauthorized has gained access to your account.

3. AI-Generated Content

Some parts of SagoAI use artificial intelligence to create stories, text, illustrations, and audio narration.

AI-generated content is automatically created and can vary even when similar choices or instructions are used.

We strive to ensure that the content is safe and appropriate for the Service's target audience, but artificial intelligence can sometimes produce unexpected, incorrect, or inappropriate results.

Therefore, we cannot guarantee that AI-generated content is always:

  • exactly right,
  • flawlessly,
  • unique,
  • suitable for each individual child or situation.

Therefore, an adult should make their own assessment of AI-generated content, especially before personalized content is shown to younger children.

If you come across inappropriate or incorrect content, please feel free to report it to us.

4. Information Used to Create Content

When creating custom content, you can leave information such as names, interests, themes, characters, or other preferences in the app's text field.

Do not use real full names, addresses, schools, contact information, health information, or other sensitive personal information when creating a story. We recommend using fictional names.

You are responsible for ensuring that you have the right to provide the information you use.

You are not allowed to use SagoAI to create or submit content that:

  • is illegal,
  • violates the rights of others,
  • contains threats, hate speech, or harassment,
  • is sexually inappropriate or otherwise unsuitable for the purpose of use of the Service,
  • attempt to bypass the service's security features,
  • contains information that you do not have the right to use.

We may limit or stop the generation of content that violates these rules.

5. Story Balance, Audio Tokens and In-App Purchases

SagoAI uses story credits to create new stories and audio tokens to create audio narration.

One story credit is used when a new story is created. Illustrations are included in the created story, and the number of illustrations depends on the selected age group.

One audio token is used when audio narration is created for a story. Once created, the narration can be played again without using additional audio tokens.

The price and contents of available packages are displayed before a purchase is made.

Story credits and audio tokens can be purchased using the payment methods available on the platform where SagoAI is distributed, such as the Apple App Store and, where the Service is available, Google Play.

The payment is processed by the current platform. We usually do not have access to your full payment or card details.

Story credits and audio tokens:

  • have no cash value,
  • cannot be redeemed for cash,
  • are intended for use within SagoAI,
  • cannot be transferred between different user accounts as a general rule.

Story credits and audio tokens do not expire while the account remains active. When the account is deleted, any remaining balance is also deleted, subject to mandatory law and platform rules.

The right of withdrawal, refund, and complaint are governed by applicable consumer laws and the rules of the Apple App Store or Google Play. If the immediate delivery of digital content results in the termination of the right of withdrawal, the user will be notified of this and asked to provide the consent required by law.

Nothing in these Terms limits any rights you have under mandatory consumer protection law.

6. Generation Failures

In some cases, AI generation may fail due to technical issues.

If a story credit or audio token was used without the requested content being generated, SagoAI may restore the balance automatically or after you contact support, depending on the circumstances.

We reserve the right to review the transaction before the balance is restored.

7. Intellectual Property Rights

SagoAI, including the app's design, trademarks, graphics, ready-made stories, characters, software, and other materials provided by us, WeNova, or our licensors, are protected by applicable law.

You retain the rights you have to information and materials that you provide to the Service yourself.

You grant us the right to process such data in a technical manner to the extent necessary to provide the functionalities you request.

Stories created for the user and other AI-generated content may be used for private, non-commercial purposes.

AI-generated content may be similar to content created for other users. Therefore, we do not guarantee that the generated content is exclusive or that it may always be protected by intellectual property rights.

Commercial use of content from SagoAI requires written permission from WeNova, unless otherwise expressly stated.

8. Availability and Changes

We strive to ensure that SagoAI operates smoothly and remains accessible, but we cannot guarantee that the Service will always be available without interruption.

Temporary interruptions may occur due to, for example:

  • maintenance,
  • updates,
  • technical issues,
  • errors with external service providers,
  • security measures.

We may develop, modify, add, or remove features in SagoAI as permitted by applicable law.

We may also change prices and content in future packages. Such changes do not affect any purchases already made in compliance with applicable laws.

If a change affects a paid digital service more than insignificantly, we will inform the user and provide the rights that follow from mandatory consumer legislation.

9. Third-Party Services

SagoAI may use external providers for services such as artificial intelligence, operations, storage, analytics, payments, and other technical functions.

The use of such providers is in accordance with applicable regulations and is described in more detail in our Privacy Policy, where applicable.

10. Prohibited Use

You are not allowed to:

  • attempt to gain unauthorized access to SagoAI or our systems,
  • interfere with or manipulate the functionality of the Service,
  • automatically collect or copy large amounts of content from the Service,
  • use the Service for illegal purposes,
  • attempt to bypass security, payment, or content restrictions,
  • using SagoAI in a way that could harm the Service or other users.

11. Suspension and Termination of Accounts

We may temporarily restrict or close an account if we have reasonable grounds to suspect:

  • violations of these terms,
  • fraud or abuse,
  • security issues,
  • illegal use,
  • attempt to manipulate payments, story credits, audio tokens, or the Service.

In the event of serious or repeated violations, the account may be terminated.

You can terminate your account yourself using the options available in the app.

The handling of personal data when an account is closed is described in our Privacy Policy.

12. Liability

SagoAI is provided with the goal of offering a safe and functional user experience.

We are not liable for any damages or losses arising from circumstances beyond our reasonable control.

We also do not guarantee that AI-generated content is always accurate, unique, or appropriate for a particular purpose.

Nothing in these Terms limits or excludes any liability or consumer rights that cannot be limited or excluded under applicable law.

13. Changes to These Terms

We may update these Terms of Use as SagoAI develops or where changes are required due to, for example, new features, technical changes or new legal requirements.

The date at the top of the page shows when the terms were last updated.

If a change is significant, we will inform the user appropriately before the change takes effect when necessary.

14. Governing Law and Disputes

These Terms are governed by Swedish law.

If you have a complaint, we kindly ask you to contact us first so that we can try to resolve the issue.

If we cannot reach an agreement, a consumer may have the right to have the dispute resolved by the General Consumer Dispute Resolution Board (ARN) or by a competent court.

Mandatory consumer protection rights apply regardless of anything stated in these Terms.

If you are a consumer and live in another country, the choice of Swedish law does not affect the binding consumer rights that apply in the country where you live.

15. Language Versions

These Terms of Use may be made available in multiple languages.

In the event of any differences or inconsistencies between the Swedish version and a translation, the Swedish version shall prevail.
